Privacy Policy

What we collect, and why.

How QliqSOFT collects, uses, and discloses information from website visitors, job applicants, and clients. Protected health information is governed separately, by the Business Associate Agreement between QliqSOFT and your healthcare provider. Companion documents: the Terms of Service and Security.

Introduction

QliqSOFT, Inc. ("QliqSOFT," "we" or "us") is committed to protecting the privacy and security of your personally-identifying information. This Privacy Policy explains how QliqSOFT, Inc. collects, uses, and discloses information from website visitors, job applicants, and our current or prospective clients ("clients" or "you"), when you use our website, platform, and other online products and services that link to this policy (collectively, the "Services") or when you otherwise interact with us. By using the Services you consent to this Privacy Policy.

As used in this Privacy Policy, "personal information" means any information that can be used to individually identify a person or household, and may include, but is not limited to, name, email address, mobile telephone number, and other information reasonably linkable to an individual or household with or without other identifying information in our possession. Personal information also includes information relating to a person's professional background, and may include education, training, employment history, and certifications. The decision to provide this information is voluntary. However, if you choose not to provide the requested information, you may not be able to use certain features of the Services.

With your permission, which you may withdraw at any time, we will collect your contact lists and/or address book data. This allows us to connect users of the Service and place them in appropriate user groups. As such, we may indicate who of your connections are also users of the Service, and likewise, we may indicate to your connections the same regarding you. This feature allows you to connect with other users of the Service and may allow other users of the Service to communicate directly with each other. In order to do this, and to make sure we give users the most up-to-date information, we will periodically check for updates to your contact lists and/or address book data.

If you provide your third-party account credentials to us via a single-sign-on integration or otherwise sign in to the Services through a third-party site or service, you understand some content and/or information in those accounts ("Third Party Account Information") may be transmitted into your account with us if you authorize such transmissions, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy.

This Privacy Policy does not apply to protected health information ("PHI") under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), its rules, or other privacy law applicable to your relationship with your healthcare provider ("Provider"). Any collected information that constitutes PHI is governed by, and will be used and disclosed solely as permitted under, the business associate agreement or services agreement between QliqSOFT and your Provider, as required by law, to safeguard PHI. For more information about the privacy of your PHI, please contact your Provider or refer to their Notice of Privacy Practices. To the extent that we receive PHI about you, that information is subject to electronic disclosure to the extent permitted by applicable law.

We may aggregate or de-identify information for various purposes, including to improve our products and Services. Aggregated or de-identified information cannot be reasonably used to identify you and is not subject to this Privacy Policy.

Updates may be made to this Privacy Policy from time to time, and will inform you by revising the date at the bottom of this policy. In some cases we may provide you with additional notice. We encourage you to review the Privacy Policy whenever you access the Services or otherwise interact with us to stay informed about our information practices and the choices available to you.

What we collect

Our consumer website and self-serve accounts are directed to adults. QliqSOFT does not knowingly collect personal information directly from individuals under the age of eighteen, and individuals under eighteen should not create accounts or submit information through this website. If you believe an individual under eighteen has provided personal information directly to QliqSOFT through this website, contact privacy@qliqsoft.com and we will delete it.

Separately, healthcare organizations may use QliqSOFT's provider-directed services in the care of minors - for example, sending care communications to a parent or caregiver. In those cases QliqSOFT processes information solely at the direction of the healthcare organization, as a Business Associate under the applicable agreement, and consent for a minor's care communications is managed by the provider. QliqSOFT has no direct relationship with the minor, and questions about information processed in connection with a minor's care should be directed to the healthcare organization providing that care.

Protection and retention

Security

QliqSOFT is committed to protecting the security of your information. We employ what we believe are industry-best security measures designed to protect your information from unauthorized access. Regardless of efforts, no data transmission over the Internet or other network, including any of QliqSOFT's services, can be guaranteed to be 100% secure. Accordingly, we cannot and do not guarantee the absolute security of any information you transmit on or through the Services, and any information you transmit is sent at your own risk.

Retention of Your Personal Information

QliqSOFT retains personal information only for as long as needed for the purposes described in this Privacy Policy. How long that is depends on the category of information and these criteria: the time needed to provide the Services you or your organization requested; our legal, tax, and accounting obligations; the resolution of disputes and enforcement of agreements; and the safety and security of the Services. When information is processed on behalf of a healthcare organization under a Business Associate Agreement, retention and return-or-destruction at the end of the engagement follow that agreement.

If you no longer want QliqSOFT to use information about you to provide the Services, you may cancel your account or ask us to delete your information as described in this policy. Log files kept for internal analysis are retained for a limited period, except where they are needed for the safety and security of the Services or we are legally required to keep them longer.

Opt-Out Preference Signals (Global Privacy Control)

We honor the Global Privacy Control (GPC) and similar recognized opt-out preference signals. If your browser sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information and as a decline of optional analytics cookies - automatically, for that browser, without requiring an account. Because QliqSOFT does not sell or share personal information for cross-context behavioral advertising and this website runs no advertising trackers, honoring the signal does not change what you can do on the site. Older "Do Not Track" settings have no settled meaning; we process the GPC signal as described here.

Use From Outside the United States

If you are using our Services from a country outside of the United States, we will collect, store, and process your personal information in the United States or other countries in the world where we or are service providers operate. Any such transfers will comply with safeguards as required by relevant law. The privacy laws that apply to us may be different from and not as comprehensive or protective as those in the country where you are. By using our Services, you understand and accept the transfer of your personal information to the United States.

SMS Terms of Service

QliqSOFT communicates to prospective customers in a number of ways. One of these is via SMS texting. By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from QliqSOFT, Inc. This includes SMS messages for conversations (external). Message frequency varies. Additional Information for Residents of Certain Jurisdictions

U.S. State Privacy Rights

This section is for residents of U.S. states with comprehensive privacy laws, including California (CCPA as amended by the CPRA), Texas (TDPSA), Virginia, Colorado, Connecticut, and Utah. Where this section conflicts with anything else in this Privacy Policy, this section controls for those residents. "Personal information" here carries the meaning given by your state's law. Information governed as protected health information under HIPAA - or as medical information under laws such as California's Confidentiality of Medical Information Act - is handled under those frameworks and the applicable healthcare organization's agreements, not this section.

How to exercise these rights

Submit a request by email to privacy@qliqsoft.com or by phone at (866) 295-0451. We will verify your identity using information associated with your account or prior interactions, and we respond within 45 days, extendable once by a further 45 days where reasonably necessary (we will tell you if we need the extension). You may use an authorized agent to submit a request on your behalf; the agent must provide written proof of your permission at the time of the request, and we may still verify your identity directly.

Appeals. If we decline your request, we will explain why. Residents of states that provide an appeal right (including Texas, Virginia, Colorado, and Connecticut) may appeal by replying to our decision or emailing privacy@qliqsoft.com with the subject "Privacy Request Appeal." We respond to appeals within the period your state's law requires; if the appeal is denied, you may contact your state Attorney General.

Opt-out preference signals. As described above, we honor the Global Privacy Control as a universal opt-out signal.

Washington and other consumer-health laws. Where laws such as Washington's My Health My Data Act apply to consumer health data collected through this website, we collect and share such data only with consent or as necessary to provide services you request.

International

International Visitors:

If you are in the European Economic Area (EEA), the United Kingdom, or Switzerland, this section describes the additional rights and information that apply to you. QliqSOFT, Inc. is the controller for personal information collected through this website; where QliqSOFT processes information on behalf of a healthcare organization, that organization is the controller and QliqSOFT acts as processor under its instructions.

Legal bases for processing

We process personal data where: processing is necessary to perform a contract with you (providing the Services you request); you have given consent (for example, optional analytics cookies - which you may withdraw at any time); processing is in our legitimate interests and not overridden by your rights (securing and improving the Services, preventing fraud); or processing is necessary to comply with law.

Your rights

Subject to the conditions in the GDPR, you have the right to access the personal data we hold about you, to rectify inaccurate data, to erasure, to restrict processing, to data portability, to object to processing based on legitimate interests, and to withdraw consent at any time without affecting the lawfulness of processing before withdrawal. To exercise any of these rights, contact privacy@qliqsoft.com. You also have the right to lodge a complaint with a supervisory authority in the EEA member state of your residence, place of work, or of an alleged infringement (or with the UK Information Commissioner's Office).

International transfers

QliqSOFT is based in the United States, and information we collect is processed there. Where personal data is transferred from the EEA, the UK, or Switzerland to the United States, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses (and the UK addendum where applicable).
