QliqSOFT, Inc. ("QliqSOFT," "we" or "us") is committed to protecting the privacy and security of your personally-identifying information. This Privacy Policy explains how QliqSOFT, Inc. collects, uses, and discloses information from website visitors, job applicants, and our current or prospective clients ("clients" or "you"), when you use our website, platform, and other online products and services that link to this policy (collectively, the "Services") or when you otherwise interact with us. By using the Services you consent to this Privacy Policy.

As used in this Privacy Policy, "personal information" means any information that can be used to individually identify a person or household, and may include, but is not limited to, name, email address, mobile telephone number, and other information reasonably linkable to an individual or household with or without other identifying information in our possession. Personal information also includes information relating to a person's professional background, and may include education, training, employment history, and certifications. The decision to provide this information is voluntary. However, if you choose not to provide the requested information, you may not be able to use certain features of the Services.

With your permission, which you may withdraw at any time, we will collect your contact lists and/or address book data. This allows us to connect users of the Service and place them in appropriate user groups. As such, we may indicate who of your connections are also users of the Service, and likewise, we may indicate to your connections the same regarding you. This feature allows you to connect with other users of the Service and may allow other users of the Service to communicate directly with each other. In order to do this, and to make sure we give users the most up-to-date information, we will periodically check for updates to your contact lists and/or address book data.

If you provide your third-party account credentials to us via a single-sign-on integration or otherwise sign in to the Services through a third-party site or service, you understand some content and/or information in those accounts ("Third Party Account Information") may be transmitted into your account with us if you authorize such transmissions, and that Third Party Account Information transmitted to our Services is covered by this Privacy Policy.

This Privacy Policy does not apply to protected health information ("PHI") under the Health Insurance Portability and Accountability Act of 1996 (HIPAA), its rules, or other privacy law applicable to your relationship with your healthcare provider ("Provider"). Any collected information that constitutes PHI is governed by, and will be used and disclosed solely as permitted under, the business associate agreement or services agreement between QliqSOFT and your Provider, as required by law, to safeguard PHI. For more information about the privacy of your PHI, please contact your Provider or refer to their Notice of Privacy Practices. To the extent that we receive PHI about you, that information is subject to electronic disclosure to the extent permitted by applicable law.

We may aggregate or de-identify information for various purposes, including to improve our products and Services. Aggregated or de-identified information cannot be reasonably used to identify you and is not subject to this Privacy Policy.

Updates may be made to this Privacy Policy from time to time, and will inform you by revising the date at the bottom of this policy. In some cases we may provide you with additional notice. We encourage you to review the Privacy Policy whenever you access the Services or otherwise interact with us to stay informed about our information practices and the choices available to you.

Our consumer website and self-serve accounts are directed to adults. QliqSOFT does not knowingly collect personal information directly from individuals under the age of eighteen, and individuals under eighteen should not create accounts or submit information through this website. If you believe an individual under eighteen has provided personal information directly to QliqSOFT through this website, contact privacy@qliqsoft.com and we will delete it.

Separately, healthcare organizations may use QliqSOFT's provider-directed services in the care of minors - for example, sending care communications to a parent or caregiver. In those cases QliqSOFT processes information solely at the direction of the healthcare organization, as a Business Associate under the applicable agreement, and consent for a minor's care communications is managed by the provider. QliqSOFT has no direct relationship with the minor, and questions about information processed in connection with a minor's care should be directed to the healthcare organization providing that care.

There are three general categories of personal information we collect:

• Information you provide to us;
• Information we automatically collect from your use of the Services; and
• Information we collect from third parties.

Information you provide to us

We collect information you provide directly to us, for example, when you create an account, participate in any interactive features of the Services, fill out a form, request customer support, apply for a job with us, or otherwise communicate with us.

The types of information we may collect from you include:

• Account information: when you register for an account with our Services, you will need to provide us with certain personal information to complete the registration, including information that can be used to contact or identify you, which may include your name, email address, username, password, and phone number.
• Customer information: when you contact our sales team or customer support team, or when you request more information about our Services, we may collect your name, email address, phone number, profession, company name, company address, number of employees, company website, and other professional information.
• Information about others: we may collect information about other individuals, such as the names and the contact information of your Providers and dependents under your care.
• Other information you choose to provide: we may collect additional information that you provide, such as when you request technical or customer support, communicate with us, or apply for a job with us.

Information we collect when you use the Services

When you access or use our Services, we automatically collect information about you, including:

• Usage information: we may collect information about your activity on our Services.
• Unique Device Identification: we automatically collect information on the type of device you use and the device identifier (or "UDID")
• Browser Identification: we automatically collect information regarding the type of web browser you use, your operating system, your Internet Service Provider, your IP address, the pages you view on our Site, the time and duration of your visits to the Site
• Log information: we may collect log information about your use of the Services, including the type of browser you use, access times, pages viewed and visited, and your IP address.
• Information collected by cookies and other tracking technologies: we and our service providers may use various technologies to collect information, including cookies and web beacons. Cookies are small data files stored on your hard drive or in device memory that help us improve our Services and your experiences, see which areas and features of our Services are popular, and count visits. Web beacons are electronic images that may be used on our Services or emails to help deliver cookies, count visits, and understand usage and campaign effectiveness. Please see our separate Cookie Policy to learn about how we use cookies on the Services and your choices in relation to the use of cookies.
• Marketing analytics and how visits are linked to you: on our public website, with your consent, we use Google Analytics, HubSpot, our customer relationship management provider, and Contentsquare, which records how visits unfold (pointer movement, clicks, scrolling, and the page as displayed, with form contents masked) so we can replay them and improve the site. HubSpot places an identifier in your browser and records the pages you view and the links you click against that identifier while you are anonymous to us. If you later submit a form and provide your email address, HubSpot associates that earlier browsing history with your contact record, so activity that took place before you identified yourself becomes linked to you. HubSpot also receives your IP address and uses it to estimate your general location and, for business visitors, the organization you are browsing from. In the EEA, the UK, and Switzerland none of this loads until you accept. Elsewhere it loads with the page and the notice tells you so; turning Analytics off in "Your Privacy Choices" stops it and deletes the identifier. Cookie choices. Analytics and advertising cookies are controlled separately from the rights requests described below, by the "Your Privacy Choices" link in the footer of every page. That panel takes effect immediately and needs no verification, because it acts only on your own browser. To opt out of any sharing that does not happen in your browser, email privacy@qliqsoft.com. We respond within 15 business days. Requests to access, correct, or delete personal information follow the 45-day timeline described under "How to exercise these rights" below.

Information we collect from other sources

We may obtain personal information from other sources and use it as contemplated herein, including to provide the Services and otherwise communicate with you.

We may use personal information about you for various purposes, including to:

• Provide and deliver the products and Services you request;
• Maintain and improve our Services;
• Send you technical notices, updates, security alerts, and support and administrative messages;
• Respond to your comments, questions, and requests, and provide customer service;
• Communicate with you about products, services, offers, promotions, rewards, and events offered by QliqSOFT and provide information we think will be of interest to you;
• Monitor and analyze trends, usage, and activities in connection with our Services;
• Detect, investigate, and prevent fraudulent transactions and other illegal activities and protect the rights and property of QliqSOFT; and
• Such other purposes as you may consent or may be permitted or required by law.

We may share information about you as follows or as otherwise described in this Privacy Policy:

• With vendors, consultants, and other service providers who need to access such information to carry out work on our behalf;
• With HubSpot, Inc., which hosts our customer relationship management system and processes website form submissions and, with your consent, website analytics on our behalf under a data processing agreement, and with Google LLC for website analytics, tag management, and form abuse prevention. Both act as our service providers and are not permitted to use the information for their own purposes;
• In response to a request for information if we believe disclosure is in accordance with, or required by, any applicable law, regulation, or legal process;
• With other users of the Services as you direct through your use of the Services;
• In relation to exercising or protecting the rights, property, and safety of QliqSOFT;
• In connection with, or during negotiations of, any merger, sale of company assets, financing, or acquisition of all or a portion of our business by another company;
• Between and among QliqSOFT and its current or future parents, affiliates, subsidiaries, and other companies under common control and ownership to the extent permitted by applicable law; and
• With your consent or at your direction, or as may be permitted or required by applicable law.

Links to Third Party Sites

Our Services may contain links to other websites, and other websites may reference or link to QliqSOFT and our Services. These other websites are not controlled by QliqSOFT. QliqSOFT does not endorse, screen, or approve, and are not responsible for, the privacy practices or content of such other websites or web applications, and encourage users to review each website's own Privacy Policy.

QliqSOFT is committed to protecting the security of your information. We employ what we believe are industry-best security measures designed to protect your information from unauthorized access. Regardless of efforts, no data transmission over the Internet or other network, including any of QliqSOFT's services, can be guaranteed to be 100% secure. Accordingly, we cannot and do not guarantee the absolute security of any information you transmit on or through the Services, and any information you transmit is sent at your own risk.

Retention of Your Personal Information

QliqSOFT retains personal information only for as long as needed for the purposes described in this Privacy Policy. How long that is depends on the category of information and these criteria: the time needed to provide the Services you or your organization requested; our legal, tax, and accounting obligations; the resolution of disputes and enforcement of agreements; and the safety and security of the Services. When information is processed on behalf of a healthcare organization under a Business Associate Agreement, retention and return-or-destruction at the end of the engagement follow that agreement.

If you no longer want QliqSOFT to use information about you to provide the Services, you may cancel your account or ask us to delete your information as described in this policy. Log files kept for internal analysis are retained for a limited period, except where they are needed for the safety and security of the Services or we are legally required to keep them longer.

Opt-Out Preference Signals (Global Privacy Control)

We honor the Global Privacy Control (GPC) and similar recognized opt-out preference signals. If your browser sends a GPC signal, we treat it as a request to opt out of the sale or sharing of your personal information, automatically, for that browser, without requiring an account. We turn advertising cookies off and keep them off, and we do not record your session. First-party analytics is not a sale or a share, so outside the EEA, the UK, and Switzerland analytics continues unless you turn it off yourself, and we show you the notice once with a line confirming that the signal was received and honored. Inside the EEA, the UK, and Switzerland, where the standard is consent rather than opt-out, we treat the signal as a refusal of everything optional and show no notice at all. Honoring the signal turns the advertising tags on this website off for that browser (Google Ads, LinkedIn, Microsoft Advertising, and the Meta Pixel) and does not change what you can do on the site. Older "Do Not Track" settings have no settled meaning; we process the GPC signal as described here.

Use From Outside the United States

If you are using our Services from a country outside of the United States, we will collect, store, and process your personal information in the United States or other countries in the world where we or are service providers operate. Any such transfers will comply with safeguards as required by relevant law. The privacy laws that apply to us may be different from and not as comprehensive or protective as those in the country where you are. By using our Services, you understand and accept the transfer of your personal information to the United States.

SMS Terms of Service

QliqSOFT communicates to prospective customers in a number of ways. One of these is via SMS texting. By opting into SMS from a web form or other medium, you are agreeing to receive SMS messages from QliqSOFT, Inc. This includes SMS messages for conversations (external). Message frequency varies. Message and data rates may apply. See privacy policy at https://www.qliqsoft.com/privacy-policy. Message HELP for help. Reply STOP to any message to opt out.

U.S. State Privacy Rights

This section is for residents of U.S. states with comprehensive privacy laws, including California (CCPA as amended by the CPRA), Texas (TDPSA), Virginia, Colorado, Connecticut, and Utah. Where this section conflicts with anything else in this Privacy Policy, this section controls for those residents. "Personal information" here carries the meaning given by your state's law. Information governed as protected health information under HIPAA - or as medical information under laws such as California's Confidentiality of Medical Information Act - is handled under those frameworks and the applicable healthcare organization's agreements, not this section.

Subject to the exceptions in your state's law, you have the right to:

• Know and access the personal information we have collected about you, including the categories collected, the sources, the purposes, and the categories of third parties to whom it was disclosed.
• Correct inaccurate personal information.
• Delete personal information we collected from you, subject to statutory exceptions (for example, completing a transaction you requested, security and fraud prevention, or legal compliance).
• Portability - receive a copy of your personal information in a usable format.
• Opt out of sale, sharing, and targeted advertising. QliqSOFT does not sell personal information. When you visit this website with advertising cookies on, our advertising partners (Google, LinkedIn, Microsoft, and Meta) receive identifiers about your visit so that we can show QliqSOFT ads to you on their platforms and measure whether an ad led to a demo request. California law treats that as sharing for cross-context behavioral advertising, and other state laws treat it as targeted advertising. You can opt out at any time with the "Your Privacy Choices" link in the footer of every page, or by sending a Global Privacy Control signal from your browser; either turns the advertising tags off for that browser. Visitors in the EEA, the UK, and Switzerland see no advertising tags unless they opt in.
• Limit the use of sensitive personal information. We do not use or disclose sensitive personal information for purposes requiring a right to limit; we collect it only to provide the Services requested.
• Non-discrimination - we will not deny services, charge different prices, or provide a different level of service because you exercised a privacy right.

How to exercise these rights

Submit a request by email to privacy@qliqsoft.com or by phone at (866) 295-0451. We will verify your identity using information associated with your account or prior interactions, and we respond within 45 days, extendable once by a further 45 days where reasonably necessary (we will tell you if we need the extension). You may use an authorized agent to submit a request on your behalf; the agent must provide written proof of your permission at the time of the request, and we may still verify your identity directly.

Appeals. If we decline your request, we will explain why. Residents of states that provide an appeal right (including Texas, Virginia, Colorado, and Connecticut) may appeal by replying to our decision or emailing privacy@qliqsoft.com with the subject "Privacy Request Appeal." We respond to appeals within the period your state's law requires; if the appeal is denied, you may contact your state Attorney General.

Opt-out preference signals. As described above, we honor the Global Privacy Control as a universal opt-out signal.

Washington and other consumer-health laws. Where laws such as Washington's My Health My Data Act apply to consumer health data collected through this website, we collect and share such data only with consent or as necessary to provide services you request.

If you are in the European Economic Area (EEA), the United Kingdom, or Switzerland, this section describes the additional rights and information that apply to you. QliqSOFT, Inc. is the controller for personal information collected through this website; where QliqSOFT processes information on behalf of a healthcare organization, that organization is the controller and QliqSOFT acts as processor under its instructions.

Legal bases for processing

We process personal data where: processing is necessary to perform a contract with you (providing the Services you request); you have given consent (for example, optional analytics cookies - which you may withdraw at any time); processing is in our legitimate interests and not overridden by your rights (securing and improving the Services, preventing fraud); or processing is necessary to comply with law.

Your rights

Subject to the conditions in the GDPR, you have the right to access the personal data we hold about you, to rectify inaccurate data, to erasure, to restrict processing, to data portability, to object to processing based on legitimate interests, and to withdraw consent at any time without affecting the lawfulness of processing before withdrawal. To exercise any of these rights, contact privacy@qliqsoft.com. You also have the right to lodge a complaint with a supervisory authority in the EEA member state of your residence, place of work, or of an alleged infringement (or with the UK Information Commissioner's Office).

International transfers

QliqSOFT is based in the United States, and information we collect is processed there. Where personal data is transferred from the EEA, the UK, or Switzerland to the United States, we rely on appropriate safeguards, including the European Commission's Standard Contractual Clauses (and the UK addendum where applicable).

This includes personal data processed by our service providers in the United States, such as HubSpot, Inc. and Google LLC.
